If we do cancel your contract, we will notify you by email and will re-credit to your account any sum deducted by us (in respect of Goods provided by us, and delivery services provided by the delivery service provider (unless amounts in respect of delivery are refunded directly by the delivery service provider)), from your debit or credit card as soon as possible but in any event within 14 days of the date of cancellation. We will not be obliged to offer any additional compensation for disappointment suffered.
If you have received the Goods before you cancel your order then you must send the Goods back to us at your own cost and risk. If you cancel your order but we have already processed the Goods for delivery, you must not unpack the Goods when they are received by you and you must send the Goods back to us at your own cost and risk as soon as possible.

You are responsible for maintaining the confidentiality of your password and account and any activities that occur under your account. It is important that you keep your personal details and password confidential and secure. Please note that in the event of a damaged or defective product claim, you shall be required to return such Goods to us for inspection and report (without any obligation on us to replace the said Goods prior to such inspection) and you confirm that it shall be reasonable for us to inspect such defective Goods and allow manufacturers to undertake inspections so as to allow production methods to be modified. You further accept that it is reasonable to inform us of any damage, defect or other failure prior to contacting independent third parties or incurring expense and to allow us to remedy the damage, defect or failure.
Liability
If the Goods we deliver are not what you ordered or are damaged or defective, please contact our Customer Service team as soon as possible on + 353 87 3951168 so that we can resolve the issue. All such issues are dealt with on a case by case basis.
ORDERING FROM US

The contract between us (Contract) will only be formed when we send you the Order Confirmation (and, as stated above, performance will be subject to product availability and to other clauses in these terms and conditions).
PRICES AND PRODUCTS
All Prices shown on the website are exclusive of delivery charges .
Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an Order Confirmation.
The total price for goods or services ordered, including delivery charges, will be displayed on the Website when you place your order. When you are paying by credit or debit card, payment will be taken at the time of placing your order and not when the order is dispatched.
The actual condition of each bike is described on the seller’s website with accurate photos of it. In a case when a bike may have small scratches, it does not affect its technical conditions. The Actual condition of a battery is not known, therefore we do not take any responsibility for the battery as it is a replaceable part.
Each new bike can have a covered distance in order to check if the bike is working correctly.
If an error has been made in the description of a product we may need to inform you of this and it may be necessary to cancel your order, unless you wish to purchase the product once you have been informed of the amended description. In addition, we cannot guarantee that the appearance of an item on your particular computer monitor or device will accurately reflect the exact appearance of the product.

CANCELLATION AND RETURNS
The client is able to cancel the deal at any time in the space of fourteen days starting from receiving the product.

The refunded goods should be accompanied by a description of the damage with the situation when (in which situation) the fault occurs; such a description should be as accurate as possible. To be eligible for a return, your item must be unused and in the same condition that you received it in. We DO NOT take responsibility for damages that were caused by your own using of the product. If you decide to send back the product it must contain all of its original equipment. It also must be in the original packaging or alternate safe packaging as stated in the next paragraph.
You are taking the risk of sending the item back to us; therefore you have to cover the transport costs yourself. Once you have notified us that you are returning the Goods, any sum debited to Fabiabike from your debit or credit card will be re-credited to your account as soon as possible, and in any event within 14 days of your return/cancellation request PROVIDED THAT the Goods in question are returned by you, and received by us, in the condition they were in when delivered to you. Please note we are permitted by law to reduce your refund to reflect any reduction in the value of the Goods as a result of your handling of the goods.
You will not be eligible for a refund if 1) the products are damaged. 2) Will not be in a safe packaging, alternate packaging is allowed but it has to guarantee safety for the products whilst transporting. 3) The product is stated as a second hand product. If not returned in a safe packaging we have the right to take actions against you for compensation. If there are parts missing we will not be able to accept the refund or cancel the payment for damaged parts.
When returning goods under the 14 day cooling off period, if the goods are not in a saleable condition or if the goods have been unnecessarily handled we reserve the right to offer only a partial refund.
A full statement of your legal rights under The Consumer Contracts Regulations may be obtained in the EUROPEAN COMMUNITIES (UNFAIR TERMS IN CONSUMER CONTRACTS) REGULATIONS, 1995.
If the goods supplied to you appear to have been damaged before receipt by you, then you should notify us through email, letter or by logging into your account area within 48 hours of receipt. Failure to notify us with 48 hours of receipt will result in the determination that any physical damage occurred whilst in your care.
If you suspect that the goods are faulty, and wish to return them, you must contact us within 48 hours of discovering the fault and submit an RMA (Return Material Authorisation) request. We may resolve issues or may suggest that you return the product to us for inspection. In the event of a return, we will examine the returned product and, if you are entitled, we will notify you of your options by email to either a repair, a replacement or a refund. We will usually process your elected repair, replacement or refund as soon as possible and, in any case, within 45 days of the day you confirm whether you opt for repair or replacement.
When the package is sent to the customer, we are responsible for the package not the customer. However when a client wishes to return the package he will take full responsibility for the package and make sure it is delivered back to us according to our regulations. We will not send the money back until we receive the package.
If on return your goods are found to be in working order, a no fault found fee will be charged. This will be 10% of the sale value of the item, but not less than 15 euro.
Second Hand goods are not subject to warranty because the actual condition of the electronics and the battery of the bike are unknown as the product was used beforehand. It is possible to return the product within 14 days of purchase in the condition in which it was sent to the customer. The company is not liable for damages caused by the use of the product.
Fabiabike Paweł Fabian Westport Co.Mayo F28DX72 Cloondacon, Aghagower Ireland (the seller) will inform the buyer about the inclusion or rejection of the complaint immediately, not later than within 14 days from the receipt of the complaint.
In the event of a broken bicycle, we reserve the right to check the battery of the installation and the entire bicycle, hereby, if the bicycle breaks down, it must be sent by the customer or brought to the company’s address, the costs bears the buyer for the transport of the bicycle or battery or any other parts.
WARRANTY
All products that Fabiabike Paweł Fabian Westport Co.Mayo F28DX72 Cloondacon, Aghagower Ireland supply are warranted free from defects for 12 months from the date of supply unless stated differently. Second hand bikes have a 14 day warranty and the customer is free to send back the item if he is not satisfied. The electric battery also has a 1 year warranty. This warranty does not affect your statutory rights as a consumer.
Goods found by us to be defective during the warranty period will be repaired or replaced with an item of an equal or better performance and equal or better value at the time a return material authorisation (“RMA”) is generated.
This warranty does not apply to any defect in the goods arising from normal wear and tear, wilful damage, accident, negligence by you or by any third party (e.g. not using a surge protector), flooding, non-use of overvoltage protection, use other than as recommended by us or the manufacturer, e.g. use in humid, unventilated, hot or dirty, dusty environment failure to follow the manufacturer’s instructions, or any alteration or repair carried out without the manufacturer’s approval.
DELIVERY

The seller does not accept cash on delivery.
All products will be at your own risk from the time of delivery.
Fabiabike Paweł Fabian Westport Co.Mayo F28DX72 Cloondacon, Aghagower Ireland is not responsible for the transport of the bike or any bicycle parts, the courier companies take the full responsibility for the delivery of the package and they are responsible for the transport of the package, all cases such as loss or damage, failure to deliver on time or anything else resulting from transport then you will have to contact the courier company from the tracer number sent. We will make every effort and help in clarifying the matter of the parcel lost or damaged by the courier company.

If for any reason you suspect that your username & password has been disclosed to or obtained by another party you should contact us immediately. Please note that we never contact users requesting them to confirm their username & password or other details.

Reframe or repurpose the website or any content on it or remove or obscure any notices or advertising provided by us on the website.
Advertise any item, which infringes the trademark, patent, trade secret or any other proprietary right of a third party or infringes any intellectual property law.

If you breach these Terms & Conditions by sending any unsolicited bulk email, (spam) or any other bulk communications to users your actions will cause harm to us and to the website. Such harm is difficult to quantify and as such you agree to pay us the sum of £50 for each and every individual email or other communication sent to a user or third party.

After sending the product to us in our fabiabike store, we will refund you within 10 working days (the post office takes about 14 working days to return the package to our store). Depending on the payment method, the money will be returned to your account within 14 days (Paypal) 14 days (credit card) the goods must be packed in the original packaging as it was done by fabiabike.
fabiabike does not bear the cost of returning the goods from the customer, the customer is obliged to deliver the purchased product at his own expense within 14 days to the address +353 873951168

If the courier destroys the package and the package has not been insured, the buyer covers the cost of repairing the product. the fabiabike company may also refuse to accept the package if it is open or there are visible damages on the package in the form of large scratches or abrasions by the courier company fabiabike will immediately call the customer and inform him about the condition of the package and send photos to the customer what is the condition of the product
Things to keep in mind before applying for a refund:
Item must be in its original, unused, unaltered and unwashed condition.
The item must be returned with its original tags and packing material.
Defective products used for purposes other than those for which they are intended cannot be returned. Fabike does not accept returns of used parts and used bikes after 14 days from the purchase of the products.
All shipping fees that may have been charged to the buyer during the original purchase are non-refundable.
In the rare event that you have a product with a manufacturing defect, don’t worry.
All brand products fabiabike has at least a 1 month warranty to a 2 year new-to-used warranty, there is a 14-day warranty.
If the service life exceeds 30 days, we will offer a repair solution first. If we are unable to repair your item within a reasonable time, we will replace the product. If no equivalent product is available, we will offer a full refund.
How to return items: Print the order invoice that will be attached to your confirmation email. and they came to us by email
